25 countries to get iPad a week after US launch

(AP) ? After the new iPad goes on sale Friday in the U.S. and nine other countries, Apple will make the tablet computer available in 25 additional countries a week later, mostly in Europe.

The new iPad is Apple's third version and sports a faster processing chip and a sharper screen. It works with a faster cellular network called 4G.

The countries getting the device on March 23 are Austria, Belgium, Bulgaria, Czech Republic, Denmark, Finland, Greece, Hungary, Iceland, Ireland, Italy, Liechtenstein, Luxembourg, Macau, Mexico, The Netherlands, New Zealand, Norway, Poland, Portugal, Romania, Slovakia, Slovenia, Spain and Sweden.

Besides the U.S., Puerto Rico and the U.S. Virgin Islands, countries getting it Friday are Australia, Canada, France, Germany, Hong Kong, Japan, Singapore, Switzerland and the United Kingdom. Sales begin at 8 a.m. local time.

Apple has already stopped taking advance orders for Friday and said customers should expect a two- to three-week wait for purchases made Wednesday through its online store. That means those who haven't ordered yet have to visit a retail store in person if they want it on Friday. Lines are likely to form hours ahead of opening.

Apple said the iPad will be sold in the U.S. at Best Buy, Radio Shack, Sam's Club, Target and Walmart, in addition to Apple's own stores. The basic iPad will retail for $499 to $699, depending on the amount of storage. Models capable of accessing the 4G cellular network will cost $629 to $829. Customers who want 4G models will have to choose either AT&T or Verizon Wireless in the U.S. ahead of time.

The company will still sell the previous model, the iPad 2, for $100 off the old price. The basic model now costs $399 and the cellular version, working with 3G networks, costs $529.

Buying a Timeshare in Spain - Travel - EzineMark

Have you been holidaying in Spain regularly? Is the allure of the beautiful beaches in the Costa del Sol too strong to keep from your mind? Can you not get enough of the weather and sites you cannot find elsewhere? Very often, buying a Timeshare is the best choice for some, cutting the cost of repeat package holidays whilst only being a fraction of the price many resorts may charge.

Club playa Real is paradise for many, made with your relaxation in mind, situated on the beach within a few moments travel of Marbella town and the famous Puerto Banus. On site is a magnificent outdoor poor with poolside bar, miles of beautiful beaches and "chiringutio" bars all within minutes travel, how could you refuse?

If you're looking for a destination with your family in mind, why not try Marbesa Club instead? With access to Club Playa Real's clubhouse facilities and located right next to the beach it provides everything you need for the perfect family holiday.

If you don't want to spend the majority of you time away on the Spanish roads, Marbesa club is close to local public transport routes giving you free roam of the surrounding areas.

Staying within the Marbella area, why not try Marbella Beach resort? It sits adjacent to the Club Playa Real clubhouse and members have full access to the indoor leisure facilities. Topping things off is "Le Papillon" Beach Restaurant, located ideally next to the sea providing stunning evenings and delicious food.

Maybe lazy around on the beach does not suit you, you can still choose one of the Costa del Sol's idyllic hillside clubs, Mi Jardin. But don't mistake the quite surroundings for being too far from the interest, Mi Jardin still benefits from the golden beaches only 10 minutes walk away.

The location of Mi Jardin is wonderfully complimented by its gardens, landscaped swimming pool and barbecue terraces - everything you need for relaxing days in the sun.

It hardly needs saying but the Costa del Sol is one of the most highly sought after holiday destinations in Spain, if not all of Europe. For the British especially, the Costa del Sol is the sunning destination with beaches that the UK could only but dream of.

A glorious area of Spain, the Costa del Sol has plenty to offer for those looking for going into timeshare ownership without the need to pay higher resort prices or the repeat package holiday costs.

Pantech Hotshot (Verizon Wireless)

The Pantech Hotshot (free with a two-year contract) looks and feels a lot like a smartphone, but it's actually a feature?phone in disguise. It's thin and sleek, with decent call quality, good battery life, and a nice user interface hiding behind its touch screen. But all of that is pretty much negated by a processor that's just too slow. It could have been a contender, but it's more of a swing and a miss for this Hotshot.

Design and Call Quality
The Hotshot measures 4.7 by 2.4 by 0.4 inches (HWD) and weighs just 3.2 ounces. It's made entirely of plastic; the back is matte black with a diamond-textured pattern, while the front is a shiny, metallic red. There's a covered microUSB charging port on the right side of the phone, along with buttons to activate the phone's camera and voice dialing. The left side is home to volume control keys, as well as a 3.5mm headphone jack; this location makes it strange to hold the phone in your pocket while using headphones, since the cord sticks out to the side. Aside from that, there is just one multifunction button located beneath the phone's 3.2-inch 400-by-240-pixel capacitive display. That resolution is definitely on the low side, which makes fine details and text appear grainy. And while the phone's touch screen seems responsive, the processor makes everything feel slow; more on that in a bit.

The on-screen keyboard feels cramped, and similar to other touch screen Samsung feature phones, it only presents a virtual number pad in portrait mode. To type using a QWERTY keyboard, you must turn the phone sideways. The function button beneath the display mostly serves as a Home button. But press it twice, and it'll pull up a view of all three of the phone's home screens. Hold it down and it will show you your six most recent apps, then take you to whichever one you choose.

The Pantech Hotshot is a dual-band EV-DO Rev 0 (850/1900 MHz) device with no Wi-Fi. Voice quality is mostly good overall. Voices sound good in the phone's earpiece, but become distorted at higher volumes. On the other end, calls made with the phone sound clear but thin, with below average noise cancellation. Calls sounded fine through a Jawbone Era?Bluetooth headset ($129, 4.5 stars), and the Nuance-powered voice dialing worked well over Bluetooth. The speakerphone is loud enough to use outside, but sounds a bit distorted. Battery life was good at 6 hours and 55 minutes of talk time.

Processor and Apps
The biggest problem with the Hotshot is that everything feels far too sluggish and stiff. As I mentioned earlier, I don't think this is a fault of the touch screen; capacitive screens are used in plenty of responsive devices. I think the problem lies in the processor. The Hotshot is powered by a 480MHz ARM11 processor that just isn't up to the tasks its software demands of it. Swiping between each of the three home screens results in a noticeable delay. Ditto for launching apps, and pretty much any other function you can think of. It's frustrating having to wait so often, and it makes listening to music or watching video virtually impossible; if you try to do anything else on the phone at the same time, audio will frequently pause or cut out completely as the phone tries to keep up with you.

The Hotshot has an email app with access to Gmail, Hotmail, Microsoft Exchange, Verizon.net, Windows Live, and Yahoo accounts, but it requires that you have either a minimum data plan of $9.99 per month, or pay a $5 monthly subscription fee. Since the whole purpose of a feature phone is to save money, those prices are a bummer. The Opera Mini 5.1 browser does a nice job of delivering clean WAP and HTML pages. VZ Navigator 5.1 is available for clear, voice-enabled GPS directions for $9.99 per month extra. But between that and email, you're already half of the way towards a smartphone data plan. You also get all of the standard apps, like an alarm clock, calculator, calendar, notepad, and a stopwatch.

Multimedia, Camera, and Conclusions
For multimedia, you get 220MB of free internal memory, along with a 2GB microSD card. My 64GB SanDisk card worked fine as well. On the plus side, the Hotshot had no trouble finding my media, whereas many other Verizon feature phones require specific folders for each media type. The phone is able to play AAC, MP3, and WMA music files, but as previously mentioned, pops and skip abound, through either wired earbuds or Altec Lansing BackBeat?Bluetooth headphones ($129.99, 3.5 stars). If you're trying to listen to music and do something else at the same time, it becomes nearly unlistenable. And audio still cuts out periodically even when the phone remains otherwise untaxed. Additionally, sound quality via Bluetooth is too tinny to be enjoyable. This problems extends to video playback. The Hotshot plays H.264 and MPEG4 videos at resolutions up to 640-by-480, but suffers from periodic drops in audio.

The Hotshot's 3.2-megapixel camera lacks an LED flash and auto-focus. Shutter speeds are average, and test photos taken in areas with good lighting look reasonably sharp, though a touch blown out. Lower lighting caused motion blur and smudgey details. The camera can also record videos at 640-by-480-pixel resolution at 12 frames per second, but they look choppy and grainy.

The Pantech Hotshot could've been a solid feature phone, if not for that slow processor. As it stands, you're likely better off with the Samsung Brightside ($99.99) or the LG Extravert ($79.99). We haven't tested either phone yet, but both feature touch screens as well as physical keyboards, and we expect both to perform more responsively than the Hotshot. If you're willing to drop the touch screen, the Casio G'zOne Ravine 2?($179.99, 4 stars) is our favorite voice phone on Verizon, and is super rugged to boot, but it's a lot more expensive. The LG Cosmos 2?(Free, 3.5 stars) is another solid, affordable option for Verizon users that like to text but are looking to save money.

Benchmarks
Continuous talk time: 6 hours 55 minutes

Canon PowerShot A4000 IS

Under the right conditions, the Canon PowerShot A4000 IS ($199.99 direct) is a camera capable of capturing some very nice photos, although you'll quickly lose detail if you set its ISO too high. Its optically stabilized 8x zoom lens is impressive when you consider the under-$200 price, and the 16-megapixel camera can record video 720p30 HD video. It isn't as fast as more expensive point-and-shoots, like our Editors' Choice Canon PowerShot Elph 310 HS ($259.99, 4 stars), but it's a good choice if you're on a budget. ?

Design and Features
Despite its spot in Canon's entry-level A series, the A4000 boasts a metal body, which feels much more solid than competing cameras with plastic exteriors. Our review unit was silver, but the camera can also be had in blue, red, pink, or black finishes. It isn't as small as Canon's higher-end Elph cameras?it measures about 2.2 by 3.8 by 1 inches (HWD) and weighs in at 5.1 ounces. It's actually a bit larger than the flip-screen Samsung MV800 ($279.99, 2.5 stars), which comes in at 2.2 by 3.8 by 0.9 inches and weighs 4.3 ounces.

An 8x zoom lens, covering a 28-224mm (35mm equivalent) field of view, is a highlight here. It's versatile enough for group shots, but can also zoom in to bring distant objects into clear view. The A4000's 3-inch rear LCD is packed with a modest 230k dots. It's decent enough for reviewing photos, but pales in comparison to the 460k dot screens found on more expensive cameras like the Elph 310 HS.

The menu system should be familiar to anyone who has shot with a Canon point-and-shoot before, and is simple enough for a newcomer to navigate with ease. The camera is set to Auto mode by default, but if you require some more control over your shooting, you can switch to Program mode by hitting the green Auto button on the back of the camera. There is also a Function button, which lets you modify common shooting settings?including ISO, White Balance, and Exposure Compensation?when using the camera in Program mode. There are dedicated physical controls to active Macro mode, activate the flash, and record movies. It would be nice to have a button for Exposure Compensation, as that is a function that can help novice photographers with images?setting it to the plus side of zero makes an image brighter, and setting a negative value makes your photo darker.

Performance and ConclusionsCanon PowerShot A4000 IS (Benchmark Tests)
The A4000 isn't the fastest camera in the world?but it is by no means the slowest. It can start up and shoot in 2.2 seconds, requires you to wait 1.4 seconds between shots, and records a modest 0.2 second shutter lag. It did manage to run circles around the sluggish Samsung SH100 ($199.99, 3 stars), a camera that needs 3.5 seconds to start and shoot, makes you wait 2.7 seconds between photos, and records a 0.5 second shutter lag.

I used Imatest to measure the sharpness of the A4000's lens, and found that the camera performed admirably. An image that scores 1,800 lines per picture height is considered sharp, and photos from the A4000 manage to hit 2,301 lines using a center-weighted testing metric. This is one area where the camera outshines our Editors' Choice Elph 310 HS, which managed 1,857 lines.

Imatest also measures the level of noise in photos. An excessive amount of noise?above 1.5 percent?can make photos look overly grainy. The A4000 keeps images under this threshold through ISO 800, but accomplishes this via some very heavy-handed noise reduction?a process which also saps detail from photos. It's a good idea to keep the ISO at 400 or below if you plan on printing photos or sharing them on high-resolution displays?the camera does a very good job balancing noise and image detail at that setting. Other compacts can do a better job with noise?the Panasonic Lumix DMC-FH27 ($229.95, 2.5 stars) keeps noise under 1.5 percent through ISO 1600.

Video is recorded in 720p25 HD resolution in QuickTime format with iFrame compression. The quality is just ok. Footage is grainy, even under studio lighting, and the camera is limited to digital zoom while recording. It's best to zoom in as far as you can with the lens before starting a video, as the quality drops significantly with the digital zoom. The A4000 supports SD, SDHC, and SDXC memory, and features a standard miniUSB port to connect to a computer.

If you're on a budget, the Canon PowerShot A4000 IS isn't a bad camera?as long as you are aware of its limitations. Image quality is quite good as long as you keep the ISO set at 400 and below, which will require you to use the flash in poorer light. Its 8x zoom lens is versatile, giving it a leg up over cameras like the Samsung MV800 that feature more-limited 5x lenses. The A4000's video quality is nothing to write home about, but as long as you set your zoom before recording it will be adequate for sharing via Facebook and YouTube?just don't expect to use the camera to film a Speilbergian epic. Our Editors' Choice for mid-range compacts remains the Canon PowerShot Elph 310 HS, but that camera sells for $60 more. If your budget limits you to $200, you could do much worse than the A4000 IS.

My crankshaft pullet is misaligned (it?s sticking out), and my serpentine belt keeps getting shredded. Fix?
I just bought the car from an auction ?as-is?. I noticed my camshaft pulley is sticking out a little bit, about a 1/3 of an inch so the serpentine belt gets shredded and becomes thin. So how do I push the pulley in a little more? I noticed a nut in the middle of the thing, so do I just tighten it some more. Here?s a link to where the picture of it is post?d, noticed it?s sticking out. Please help.

If the crank pulley is sticking out that far, it?s either the wrong pulley or it?s installed incorrectly. Pull it and take a look.

Why do dealers will offer whole sale ? auction value for a trade in?
I tried to trade in my 2005 RX 8 with 15 000 miles on it and they offered me whole sale/auction sale although the car is in a great condition. What can I do to contradict their argument ?we can get this at an auction? but the transaction is a trade-in. Please help !

Answer by Rob B
Sell it privately.

You won?t be able to convince the dealer to pay more than the amount they can buy a similar car for at an auction ? they are not in the business of paying out extra money for no reason.

A private buyer will be willing to pay closer to the retail value of the car, so you?ll get a better amount for your car, and at the same time they?re paying less for it than they would have to pay at a dealer.

Canadian business productivity outpaces U.S. in 2011 for first time ...

Labour productivity at Canadian businesses grew faster than at their U.S. counterparts last year for the first time since 2006, according to Statistics Canada.

The report came the same day jobs data from both countries indicated the U.S. added jobs in February, while the number of Canadian jobs contracted, suggesting Canada may be replacing jobs gains with productivity, while the opposite is true south of the border.

After posting a better-than-expected 0.7 percent gain in the fourth quarter of 2011, Canadian business productivity for the full year was up 0.8 percent, slowing from the 1.5 percent gain in 2010, Statistics Canada said.

Growth in labour productivity - a measure of real GDP, or output, per hour worked - was weaker south of the border.

After a slight increase of 0.2 percent in the fourth quarter, productivity gains at American businesses came in at a 0.2 percent, down from four percent in 2010.

"This is the first time since 2006 that productivity has grown faster in Canada than in the United States," Statistics Canada said in the release.

The difference in productivity was largely based on a difference between growth in real GDP of businesses since the two countries saw similar increases in hours worked, Statistics Canada said.

The report on Canadian productivity helped to buffer against pessimism on the labour front after Statistics Canada's February jobs report indicated that businesses are reluctant to hire.

Jobs creation last month fell short of expectations with 2,800 positions lost in the month, continuing a trend of disappointing numbers since the summer.

"Just 90 minutes after reporting another modest jobs decline, Statistics Canada delivered vivid evidence that Canada's recovery may now be relying more on brains than brawn," said Douglas Porter, deputy chief economist at Bank of Montreal.

But the productivity report indicates labour performance may finally be turning the corner after a lacklustre stretch in the middle of the recovery, Porter said.

"The much more positive counterpoint to the recent run of soggy Canadian jobs data in recent months is that labour productivity is finally showing some life."

The jobs outlook was much more optimistic in the U.S., where employers added 227,000 jobs in January to complete three of the best months of hiring since the recession began.

"While Canadian productivity growth in the past year has been no better than the long-term average, it looks to be gaining some momentum even as previously red-hot U.S. productivity is cooling," Porter said. "It truly appears like the Canadian and U.S. recoveries are trading places - Canada exiting strong jobs/weak productivity, and the U.S. leaving weak jobs/strong productivity."

In Canada, the fourth-quarter productivity report was not all rosy for Canadian businesses as hours worked fell - amid the jobs decline - in the most recent quarter for the first time in more than a year.

The gain in productivity, compared to a 0.6 percent rise in the third quarter, came as business output continued to grow, but at a slower pace than in the previous quarter, the agency said.

GDP growth at businesses was 0.5 percent, less than half the growth rate posted in the previous quarter.

The main reason for the slower pace of output was a slowdown in mining and oil and gas extraction, wholesale trade, construction and finance and insurance services.

Meanwhile, hours worked fell 0.2 percent after rising in the previous four quarters.

The fall in working hours came mostly from the construction, wholesale trade, and professional, scientific and technical services sectors.

Still, both goods-producing and services-producing businesses contributed to the overall productivity gain.

Productivity at goods-producing businesses was up 1.1 percent, largely as a result of gains in manufacturing and construction.

In the services-producing sector, productivity grew 0.5 percent, bouncing back from two consecutive quarterly declines. Professional, scientific and technical services, retail trade, and other services contributed most.

In A Tough Property Market, Bridging Loans ... - Debt Relief Company

Bridge mortgages are momentary financial instruments can give debt consolidation if utilized to offer financing during times where longer-term personal plans are held off. For example, this type of personal debt can be made use of to assist house buyers purchase real property before one more premises they own has actually sold, or until ample down payment is acquired for a next one. According to Vanguard Properties, the typical time homes remain on the market has indeed risen by as much as 2 months in the last 5 years. This makes buying property much simpler than marketing it, as well as short-term debt, has even more utility for both home vendors as well as loan providers looking for revenue in the interim period of time.

Companies such as Clopton Capital have recently decided to increase their bridge loan activity per PRWeb. More specifically, this is due to the belief that a large distressed property market also means a larger market for this type of financing. In other words, if real estate owners are more focused on saving properties they own rather than letting lenders sell them at a discount via short-sales or foreclosure auctions, then swing loans as they are also called offer a potentially viable short-term solution. Moreover, this also helps borrowers find monetary relief while finding solvency solutions such as higher business revenue or increased personal income.

The nature of the real estate and capital markets has also made bridge loans a useful financial instrument because longer-term financing is more difficult to secure. This is because credit standards are higher, subsidized lending programs have shrunk in size, and downpayment costs have increased. These changes themselves are in response to turmoil in the housing industry and because of regulatory changes such as the Dodd-Frank Wall Street Reform and Consumer Protection Act that require more stringent borrower net-worth requirements.

Even though bridge loans are shorter term, financial institutions are not always eager to finance them. This is because the mortgages they help facilitate are often dependent on a future transaction that may or may not occur. In other words, if a property does not sell, or a regulatory condition is not met, then the pending larger deal can fall through and a bank may earn less money funding the wrong type of debt instrument. In some cases swing loans are a mechanism offered by private equity firms seeking to negotiate larger, more lucrative deals, but commercial lenders offer them in the form of cross-collateralized loans or indirectly via re-purposed second mortgages.

If a swing loan is not collateralized, then it is unsecured and the interest rate or cost of the debt will be higher. Private financiers or hard money lenders have more freedom than more regulated financial institutions when making deals and are therefore more likely to be able to offer unsecured financing. However, this can come at a price in excess of 10 percent if the risk factor is high. This risk is dependent on the nature of the deal, and the underlying reasons for seeking capital. For example, short-term capital used to finance a distressed property carries a higher risk than the same used to provide cash flow for an otherwise solvent business.

[OOC] Minions

Forum rules
This forum is for OOC discussion about existing roleplays.

Please post all "Players Wanted" threads in the Roleplayers Wanted forum!

This topic is an Out Of Character part of the roleplay, ?Final Fantasy Valhalla?. Anything posted here will also show up there.

Topic Tags:

Forum for completely Out of Character (OOC) discussion, based around whatever is happening In Character (IC). Discuss plans, storylines, and events; Recruit for your roleplaying game, or find a GM for your playergroup.
Ok so this OOC tab is to clarify all the rules of Valhalla and behavior of NPCs. I will split it into three parts, but this tab is for all three.
So ideally you have seen the opening cutscene of FF XIII-2, if not go watch it: it is amazing. Regardless it features a battle in Valhalla where both Lightning and Caius summon hordes of monsters to fight for them. My rules here will be based off my interpretations of this cutscene and others throughout the game. Because nothing is spelled out in 13-2 this is open to discussion, but not debate.

1. Obtaining Minions
Long story short: summoning minions is possible in Valhalla! Hopefully this will be fun rather than confusing, and this guide will work towards that. Any NPC you defeat will become a minion to be summoned in battle.
Monsters are the main minion of Valhalla, and can be thought of as footmen. The three main monsters are Beast (the wolf-like monster in the cutscene), Wyveren (the dragon-bird thingy), and Nekton (the bug thingys). Both Caius and Lightning start with a wealth of these, everybody else starts with no monsters. Anytime you defeat a monster it becomes yours, and any monster can appear before you in Valhalla. If you want a monster other than the three listed: have it appear before you and defeat it. Yes I know that is time-consuming but it gives you something to do. If you pick a unique monster be sure to post a picture or description in this ooc thread. Otherwise you will probably gain thousands of generic minions as soon as you go up against Lightning or Caius.
Summons: Summons are an exception to monsters. Any character can have any summon (even if there are duplicates around), but preferably from your own game. You do not need to obtain them, but have them automatically. Note that monsters and summons will not win battles for you, but hopefully will make a nice change of pace or augment your own attacks.
Other characters: you can choose to dominate other characters after besting them in battle. Remember no one dies in Valhalla. A defeat will either be the standard KO or a verbal admission of defeat, crying 'Uncle' if you will.

2. Controlling Minions
Minions are obtained anytime you best an opponent.
Monsters can be summoned to be defeated at anytime, and can be summoned to attack other characters at anytime. If your monster goes down from another character, their loyalties switch. You cannot summon a monster immediately after obtaining it, but wait until the next battle.
Summons are pre-set and cannot switch loyalties, but are simply banished from the battle when defeated.
When you defeat another character: You can chose to dominate them. This doesn't mean they are your slave, it simply means you can force them to assist you in battle. Thats it. They are in no obligation to fight hard for you, and as soon as they are defeated they are no longer obligated to you. You can only be dominated by one person at a time. Unlike monsters they cannot be summoned, and are only obligated to you if they are in speaking distance. Indeed there is no way to keep them by your side. This simply means that battles will shift rapidly as allegiances change. Please don't fight this, I know it sounds bad but it is very temporary and should make for an element of unpredictability.

3. Actions of NPCs
As much as I would love to play every NPC I will not. So the rules for who controls the actions of NPCs are laid out here, if you don't know NPC=non-playable character.
Monsters will be given a direction by the summoner. Yet monsters actions will without fail be controlled by the person they are attacking. Feel free to destroy them if you wish, these are child's play to FF characters after all.
Summons are similar. Given direction by the summoner, actions stated by the prey. There are two exceptions. One, because Yuna only fights with summons they will be treated as her weapon, and she will spell out their actions. Two, if you are using them as a vehicle you will have control of their actions. But if they are a vehicle they shouldn't have much offensive power.
Characters: NO GOD-MODDING! Only authors control actions of their characters, including wether or not they are hit by an attack.

I hope this guide helps, and that I haven't scared you off yet! If you have any questions please ask. You are not required to use any of these features, but I want this to be fun. I rarely find anything more entertaining than unpredictable battles and slaughtering hordes of monsters.

Education

Blackboard_by_Winslow_Homer,_1877
Monday I watched a CBS This Morning interview with Joel Klein, former NYC Department of Education Chancellor.? The five minute interview can be seen on the CBS website.

The first questions to Mr. Klein concerned the fact that the candidates are not discussing education.? A graphic showed that out of more than 40 hours of candidate questions, less than twenty minutes was spent on education, a dozen questions out of more than 800.? Reference was made to the esteem in which many other countries hold their teachers ? much higher than we do. Just over half way into the interview, the reporter moved on to questions about the Murdoch scandals and education was forgotten, again.

Our media creates ? and destroys ? heroes.? They are aware of this ability, yet ignore teachers (and education) for the prurient glimpses of scandal and celebrity-hood.? We collude with the media by responding to their lead.

A few days ago, one of our church members ? a teacher ? wrote:

Just a word to 7th and 8th graders. Life is all about attitude, strive to have a good spirit. Use as few words as possible, let your actions and your attitude do the talking for you. Go to school every day, find something good about every teacher and then tell your teacher. It's all about attitude and how you look at things. School and teachers are not your enemy, but your friends. Remember you may lose lots of things in life, but you can't lose a good education. Work hard and have a great spirit and good things will happen. Keep life simple and have a great year, good luck.? Coach Horton

That?s not just for 7/8th graders ? it?s important to all of us. Education is no longer important to Americans, and our work force is impacted.

We adults need to follow Coach Horton?s admonition, too.? We need to find the good in our teachers and help them mold the next generation.? We need to lift them much higher than we do those who simply entertain us ? unless entertainment is all we want out of life.

How does this fit with the Bible?? The verse our school children should learn very early is:

Study to shew thyself approved unto God, a workman that needeth not to be ashamed, rightly dividing the word of truth. (2 Timothy 2:15 KJV)

Solomon?s Proverbs refer to knowledge many times ? my favorite is:

Receive my instruction, and not silver; and knowledge rather than choice gold. (Proverbs 8:10 KJV)

But ? that?s not what we?re teaching them, is it?

My husband and I have no children in school, but we pay taxes to provide for those who do.? We need to be just as interested in the teachers as their students? parents are. We do have grand and great-grandchildren in school and their future is important to us.? They need instruction and knowledge. They need the best of opportunities to achieve their goals. Those opportunities come with the proper education in order to study, becoming unashamed workmen.

How you break digital law daily (and what to do)

Featurepics.com

By Adam Dachis, Lifehacker

You share music, rip DVDs, make Hitler whine about your first world problems, and much more in the course of your regular online activities ? and more often than not, you do these things without giving a thought to the fact that you're actually breaking the law. Here's a look at how you're inevitably circumventing copyright law and what you can do to protect yourself.

Why it's almost impossible to avoid breaking copyright law
Copyright law is extremely complex. It's so complex that lawyers, lawmakers, and experts heavily argue over how it's interpreted and applied. Nonetheless, if you commit a crime, you can't use ignorance as an excuse. The law doesn't (officially) offer leniency for misunderstanding or lack of knowledge. So how can you comply with convoluted copyright laws when you can't realistically understand them all? You can't, and so you may end up breaking these laws on a regular basis without ever knowing it.

To make matters worse, a spectrum of illegality makes it acceptable to break the rules in some circumstances yet not others. Experience tells us that uploading a home video to a video sharing website (e.g. YouTube) that features a copyrighted song is sometimes okay, but downloading a television episode is not.

Both of these actions are similarly illegal, but the first example is regularly tolerated while the second can lead to a loss of Internet connectivity, a fine, or even jail time (depending on the number of offenses and how often copyright holders decide to "catch" you).

Just as it's easier for us to circumvent copyright law online, it's easier for copyright holders to come after us. I spoke with Derek Bambauer, assistant professor of law at Brooklyn Law School, who explained this is particularly problematic because infringement is often only a byproduct of the way we communicate and bears no intention of doing anything illegal:

The tricky thing is, if you and I want to share a recipe then I photocopy it and then come over to your office and give it to you ? so it's just you and me. If I want to do it online, the odds are pretty good that we're going to do it on a social network or a blog or something like that. That means that the blog is all of the sudden a choke point ? something that people who want to keep us from doing this can exert control over. The way the law deals with this is with the notice of takedown under the Digital Millennium Copyright Act (DMCA), but that's just on the copyright owner's say-so. The copyright owner says "That's infringing!" and the site should take it down. You can get it back up, but you have to file a counter notice and it takes somewhere between 10 and 14 days. It's a lot of hassle. Copyright owners, through the DMCA, have a good deal of control over the way we communicate.

But because rights holders are often fickle about what they choose to have removed and what to leave alone, it's difficult to rely on the law for guidance. The result is that we ? the average users and consumers of the Internet ? are unsure of how to proceed when dealing with copyrighted works and either have to assume we have no rights or make our best guess and hope it doesn't lead to legal consequences.

It all comes down to this reality: you will often have to circumvent or ignore copyright law to go on with your regular activities. Fortunately, there are ways to handle these circumstances better and keep yourself out of trouble. In this post, we're going to look at specific situations you encounter on a regular basis and what you can do to protect yourself.

The ways you're breaking the law (and how you can protect yourself)
Tolerated action: Mix "tapes"

The idea of the mix tape has been around for many years. It came with the invention of the compact cassette tape and the ability to record songs from the radio or other sources. This made it possible for us to create our first "playlists" of songs we liked and share them with others. With tapes, this required time and effort. Now that we have digital music files, we can throw together a mix "tape" in a matter of seconds. Initially this was a big problem because it removed the barrier of effort from sharing copyrighted music with others.

While the action of making a mix tape violated copyright law, too, it was tolerated because it required a lot of effort, had a inefficient method of mass distribution, and was often an effective marketing tool.

Digital files made mass distribution both efficient and easy, which led to intolerance on behalf of the Recording Industry Association of America (RIAA) and several ineffective law suits. Today, sharing is mostly tolerated because the problem appears to be insurmountable. The recording industry, to some extent, has found it necessary to accept the existence of music piracy and begrudgingly align themselves with online music sales and distributions services like Apple's iTunes and the Amazon MP3 Store. For the most part, consumers won the battle because they ended up with simple online purchasing methods that cost less money and music that, essentially, has no real restrictions of use.

Despite all of that, you're legally prohibited from sharing your music on a large scale. Posting the actual song files online is particularly problematic. The recording industry even fought Amazon's Cloud Drive, which allows the online storage and playback of digital music without any sharing features at all. While Amazon ultimately won that battle, you and I don't have their legal resources.

If you decide to store a few songs online and share them openly with others ? even if it's solely for the purpose of collective listening at a party or office environment ? you run the risk of account suspension with the company hosting your files. You could even face legal action, although a DMCA takedown request asking you to simply remove the files is the most likely consequence.

While you're putting yourself at risk by uploading your music to, say, a Web host, there are several services you can use to share music with others without the likelihood of retribution. Turntable.fm is one of our favorite collaborative playlist services. It allows you to upload songs online and faux-DJ with others who join your room. They can contribute songs to the playlist as well and everyone can provide live feedback about the music they're hearing. Chatting is also an option.

While there are few dire consequences nowadays when it comes to sharing music online, using a service like Turntable.fm offers a better experience than simply posting files. This kind of reasonable use is tolerated, even though it's not perfectly legal or desired by the recording industry.

Illegal action: Downloading TV shows and movies
It's unlikely that anyone who's spent a moment online is unaware of the illegality associated with downloading unlicensed TV shows and movies from file sharing services. Nonetheless, it's extremely common, but the cause varies. While some are undoubtedly stealing television and film content because they simply do not want to pay, many are employing piracy because the barrier to entry is unrealistic for most consumers.

Derek Bambauer explains, using HBO's "Game of Thrones" series as an example:

If you want to see "Game of Thrones" (and I do), your options are 1) subscribe to cable plus HBO, or 2) pirate. I think the series rocks, but I'm not paying $100 a month for it. If HBO expects me to do so, it weakens their moral claim against piracy. Unconvinced? Imagine instead that HBO offers to let you watch "Game of Thrones" for free ? but the only place on Earth you can view the series is in the Kodak Theater in Hollywood. You're located in rural Iowa? Well, you've no cause for complaint! Fly to LA! I suspect that translating costs into physical costs makes the argument clearer: HBO charges not only for the content, but bundles it with one particular delivery medium. If that medium is unavailable to you, or unaffordable, you're out of luck. Unless, of course, you have broadband, and can BitTorrent.

So what can you do? As you might imagine from Derek's example, your options are pretty limited. Although you can find many shows and movies on services like Netflix, Hulu, Amazon, and iTunes, those services are often lacking in content (like "Game of Thrones") that is too difficult, expensive, or sometimes even impossible (e.g. if you live outside of the United States) to acquire.

Although you can encrypt and anonymize your BitTorrent traffic or subscribe to a Usenet provider that offers a connection via SSL to protect yourself when downloading anything from either service, you still have no legal right to download any copyrighted content without expressed permission.

For now there is little we can do to make this situation better other than encourage the film and television industries to regard piracy as competition. As iTunes has proven with music and cartoonist The Oatmeal has cleverly illustrated, when it's easier and affordable to use the legal route, that's the route most people will take.

Tolerated action: Mashups and other derivative works
Creating derivative works ? the process of using copyrighted material to create something new ? is illegal if you do not obtain permission from the rights holders. Nonetheless, this action is often tolerated because it often serves as a unique marketing tool for the content in use. Whether a derivative work will be tolerated or not is entirely unknown as rights holders have reacted both positively and negatively in many circumstances.

A popular example of a derivative work that has both been prosecuted and tolerated is the Downfall/Hitler Reacts meme. Despite the approval of the original film's director, the production company (Constantin Films) began serving DMCA takedown notices to YouTube for the parodies because they were seen as distasteful by one of the company heads. Many were re-uploaded to YouTube and other sites and Constantin Films gave up the pursuit after a few months. The derivative work was simply too popular to silence.

This situation is indicative of the problem you face when creating derivative works without permission. Because you are circumventing copyright law, you know you have the risk of your work being removed from the Internet. You would, ideally, obtain permission before posting a derivative work you created, but that course of action is often too difficult and too expensive for the average person. Professional and political activist Lawrence Lessig aligns many derivative works with quoting and believes preventing this action stifles creativity:

Both professionals, such as the band Girl Talk or the artist Candice Breitz, and amateurs, including thousands creating videos posted on YouTube, are finding themselves the target of overeager lawyers. Because their creativity captures or includes the creativity of others, the owners of the original creation are increasingly invoking copyright to stop the spread of this unauthorized speech. This new work builds upon the old by in effect "quoting" the old. But while writers with words have had the freedom to quote since time immemorial, "writers" with digital technology have not yet earned this right. Instead, the lawyers insist permission is required to include the protected work in anything new.

Though Lessig's hopes for the future of remixes and mashups are better for creativity, for now they are just hopes. That said, you're not forced into simply posting your work online and hoping for the best. There are a few things you can do to avoid those overeager lawyers. Derek Bambauer offers a few suggestions:

  1. Post to smaller, niche-sharing sites that don't automatically remove content that may contain (or appear to contain) copyrighted works.
  2. If you want to post to larger sites, mirror the content on smaller sites as well.
  3. Post to sites that use off-shore servers and are not subject to the DMCA.

Of course, creating a mashup or other kind of derivative work without expressed permission means you are breaking copyright law. If you profit from the work, you are absolutely putting yourself at risk. Although recent history has shown us that derivative works generally receive little more than a DMCA takedown notice, the risk is still present. Consider it heavily before you choose whether or not to proceed.

Illegal action: Removing copy protection
In general, the Digital Millenium Copyright Act (DMCA) prevents the removal of any copy protection methods employed by a media publisher. In July 2010, a few exceptions were made for various forms of media in specific circumstances. Many people took these new rules to mean you could now break copy protection schemes on legally obtained media and software. For example, many cheered on the right to rip a DVD for use on their portable media players and smartphones. The problem is that ripping a DVD for personal use still isn't permissible by law. Here are the actual exceptions:

  • You can rip a DVD to obtain a portion of its contents for educational purposes or criticism, governed by fair use.
  • You can jailbreak, root, or unlock your phone to run legally obtained software or to use it with a different carrier.
  • You can break video game encryption for security-testing purposes.
  • You can crack computer programs that require hardware dongles to run only if the dongles are obsolete or unobtainable.
  • You can use a computer-synthesized voice to read an e-book to you regardless of any restrictions imposed by that book or its publisher.

When it comes to reasonable personal use, the law really isn't on your side. The advantage you do have, in most cases, is anonymity. If you're breaking copy protection so you're able to use legally obtained media or software in the way that you want without sharing it, it's virtually impossible for anyone to find out. It's also very unlikely that you'd prosecuted for breaking copy protection solely for personal use because proving damages would be difficult and not worth the cost. For the most part, you're in the clear and really only have to worry if you find yourself in the highly unlikely circumstance of having your hard drive seized during a legal investigation.

There are really only two minor concerns you'll want to be aware of. The first relates to a decision in the case of RealNetworks v. DVD CCA, which decided the manufacturing of DVD ripping tools was illegal. Said the Electronic Frontier Foundation:

While it may well be fair use for an individual consumer to store a backup copy of a personally owned DVD on that individual's computer, a federal law has nonetheless made it illegal to manufacture or traffic in a device or tool that permits a consumer to make such copies.

This means there is some risk of DVD-ripping tools becoming unavailable. Nonetheless, this decision was made in 2009 and thus far there is no lack of available options. Your other concern may be your warranty, which is really only relevant when breaking protection schemes on smartphones. While you can do this legally, you're often going to void your warranty if you cause a problem that's clearly the result of the jailbreaking, rooting, or unlocking process. The bottom line is this: don't share files or software with copy protection you've removed and proceed with caution if you warranty is at risk. Keep those things in mind and it's unlikely you'll run into trouble.

Illegal action: Using commercial software you didn't pay for
Pirated software is illegal, and that's something most of us know and wouldn't refute. That said, there are circumstances where you may have a legitimate reason for pirating an app or two. Here are a few examples:

  • You want to try out an app before you buy it but there isn't an available demo (or the trial period is unreasonably short, such as the trial/refund availabiltiy period of 15 minutes offered by the Google Android Marketplace.)
  • You purchased a used computer that came with used software but you didn't receive all the licenses and need to reinstall the software.
  • You own the software but your copy protection dongle broke or you permanently lost your registration information.
  • The copy protection imposed on your legally obtained software is frustrating and prohibitive, so you use a pirated copy despite actually owning the legal software. (I'm looking at you, music production software.)
  • Someone gave you free software and you were led to believe it was legal to use but, in reality, it wasn't.

While you should do the right thing and support developers by paying for their software, if you have a legitimate reason to use pirated software for a limited time (or to correct a problem with your legally obtained copy) you should protect yourself so you're not grouped in with people who are stealing for the sake of stealing. Currently, this means either encrypting and anonymizing your BitTorrent traffic or using subscribing to a Usenet provider that offers a connection via SSL.

Although these routes are available to you, it's best to avoid piracy altogether. If you're considering software piracy because of the high cost of software, don't forget that there are lots of ways to get steep discounts. Ultimately there are few reasonable justifications for pirating software and the law will not be on your side.

What about everything else?
The above examples only scratch the surface of the various copyright issues you can run into on a daily basis, which leaves the question of "How do I communicate and share online without putting myself at risk?"

While there's currently no clear answer, Derek Bambauer suggests you ask yourself one simple question: "Does this feel wrong to me?" While the answer may not always guide you to a fully legal answer, as copyright law is currently comprised of so many gray areas, your own moral compass is often your most reliable guide.

A very special thanks goes out to Derek Bambauer, assistant professor of law at Brooklyn Law School, for his assistance with this post. You can find his blog here. Also, thank you to my anonymous government pals who provided guidance in the early stages of writing this article. You keep me hopeful.
